Deputy State Coroner Paul MacMahon ruled that police should have terminated the pursuit of Scott Noel Pickford, 40, on Boxing Day 2012, but also found that ending the pursuit may not have been enough to save his life.
Pickford died in John Hunter Hospital on January 3, 2013 as a result of the injuries he received after failing to negotiate a bend in Masonite Road at Heatherbrae and colliding with a metal street sign.
The pursuit began after Pickford, riding a 1000cc Suzuki GSXR, sped off from police during a roadside breath test at Stockton. He sped towards Cabbage Tree Road at Williamtown and turned into Masonite Road where he crashed.
Mr MacMahon said pursuing Pickford was "futile" and police should have stopped when he entered Masonite Road.
However, Mr MacMahon said Pickford had methamphetamine in his system at the time of the crash which would have "significantly impaired" his ability to ride or drive.
