Roz Scoles, president of the South Tomaree Community Association (formerly Anna Bay Residents Action Group), said legal action had started in the fight to save 23 hectares of bushland.
"Since the day UrbanGrowth was given the green light to develop the Fishermans Bay Road site we vowed to take on the state government and the Joint Regional Planning Panel," Ms Scoles said.
"We have appointed a barrister to represent our group and a legal team from the University of Newcastle.
"Our motivation is that we believe new data on the threatened species, including koalas and the squirrel glider, was disregarded in the hearing process.
"So we have filed a judicial review in the Land and Environment Court."
On February 19 this year a four-man panel gave UrbanGrowth (formerly Landcom) the green light to push ahead with the $12.5 million subdivision, despite strong community opposition.
The Anna Bay site, bordered by Fishermans Bay Road, Clonmeen Circuit and national park, had been earmarked for housing by the state government since a rezoning approval in 1991.
An update on the development would be provided during the next association meeting to be held on Saturday, May 30, at Birubi Community Hall from 10am.
