About 1.40am on Monday, June 9, police were called to Maxwell Street after reports five young males were involved in a fight.
Port Stephens Local Area Command crime manager Detective Inspector George Radmore said the males, aged between 17 and 19, had been at an 18th birthday party, but had returned to a Maxwell Street house. An argument broke out, spilling into the street.
Police will allege a 17-year-old Tea Gardens youth used a wooden bat to assault two other males.
Off-duty Tea Gardens police arrived to find one man with a cut above his left eye and another with a cut face and lip.
One of the injured males, a 17-year-old, was taken to John Hunter Hospital.
The 17-year-old who allegedly instigated the attack was arrested and taken to Tea Gardens Police Station. A breath analysis – given under new one-punch legislation – returned a positive reading. He was released into the custody of a responsible adult.
