On June 19, Rosalind Ashton from Shoal Bay was walking on one of the designated park pathways, trying to see Migaloo the white whale.
She unsuspectingly stepped into a shallow hole and fell, hitting her head on the wooden beams that border the pathway.
"She fell quickly and I could hear the crack as her head hit the timber," her partner Graham Standen said.
The hole was formed by water run-off from the overhanging picnic hut. Vandals have seemingly stripped the hut's pipes and most of the guttering, resulting in a heavy stream of water gushing onto the pathway every time it rains.
Ms Ashton suffered facial bruising and lacerations to her head and a twisted left ankle.
An ambulance was called to the scene and she was taken to the Nelson Bay Community Hospital.
"It needs to be fixed. The park itself is not neglected, but the council needs to do something before someone else is hurt," Ms Ashton said.
John Maretich of the Port Stephens Council said the incident was being investigated.
