The man, who cannot be identified because of a suppression order, was arrested at Newcastle Police Station on Tuesday and later charged with murder, kidnapping and possession of a shortened firearm over the shooting in Hideaway Drive on August 29.
He did not enter any pleas or apply for bail and the matter was adjourned until January.
The man is the fourth arrested over the shooting and the third man charged with murder.
The other men - aged 26, 27 and 39 - remain behind bars after being arrested earlier in November.
The victim - a 45-year-old man from Tanilba Bay - was driving along Hideaway Drive, Salt Ash, about 1.45pm on Sunday, August 29 when he was shot in the face at close range by one of his passengers and crashed his car into a tree.
The 28-year-old man arrested on Tuesday is alleged to have been a passenger in the car at the time of the shooting.
